Product Limited Warranty and Liability

Limited Warranty

TRIAX LLC ("we", "our", "us") warrants that our lubricant products ("Products") are free from defects in material and workmanship and are fit for their intended purpose for a period of 5 years from the date of purchase, provided that the Products are used strictly in accordance with the applications and specifications listed on the product data sheets and are stored in appropriate conditions. This limited warranty applies only to Products purchased from authorized TRIAX distributors and used under normal operating conditions.

What This Limited Warranty Covers:

TRIAX warrants to the consumer that, at the time of sale, our lubricants are free from defective materials, design, and workmanship and are fit for use according to the written recommendations of TRIAX and in applications for which one or more of the specifications set forth in the product data sheets and product labels are specified.

What This Limited Warranty Does Not Cover:

  • TRIAX lubricants that are not packaged by TRIAX or an authorized TRIAX packager and sold by TRIAX or an authorized TRIAX dealer.
  • TRIAX lubricants that have been used in conjunction with any other product or additive not authorized for use by TRIAX.
  • TRIAX lubricants contaminated after leaving TRIAX facilities or premises, including contamination due to improper handling, repackaging, storage, or filtration, and contamination from dirty dispensing equipment.
  • TRIAX lubricants used in mechanically deficient equipment, including equipment that is flawed or defective due to abnormal operation, negligence, abuse, previous damage, or improper modification.
  • Failure of equipment due to not following original equipment manufacturer (OEM) recommendations for warranty coverage, including lubricants, maintenance, and drain intervals, prior to the first installation of TRIAX lubricants, or any other pre-existing condition or OEM defect unrelated to the use of TRIAX lubricants.
  • Repair or replacement of equipment due to normal wear and tear.
  • Failure of equipment when TRIAX lubricants are not used in strict accordance with the written recommendations of TRIAX or the OEM for warranty coverage. Outside of the data sheets we provide, the consumer is solely responsible for determining a product's merchantability or fitness ("suitability") for a particular purpose and assumes all risks and liabilities when used other than in strict accordance with either the written recommendations of TRIAX or the OEM for warranty coverage.
  • TRIAX lubricants used for racing purposes or outside their designated application.
  • Any allegedly defective TRIAX lubricant for which a reasonable sample has not been preserved.
  • Damages if the consumer does not send or make the parts requested available for inspection by TRIAX LLC or its insurer.

What TRIAX Will Do to Correct a Covered Defect:

If a TRIAX lubricant is defective in materials, design, or workmanship, TRIAX LLC will:

  1. Replace the defective lubricant; and
  2. At the option and cost of TRIAX LLC, repair or replace components damaged by the defective TRIAX LLC lubricant.

Repair or replacement, as provided in this paragraph, is the consumer's sole and exclusive remedy under this limited warranty.

What is Required to Make a Claim:

  • Provide a six (6) ounce representative oil sample taken from the failed equipment, placed into a clean, dry container.
  • If there is engine damage and the vehicle is under warranty, file a warranty claim with the OEM. If the OEM denies the warranty claim, provide a written copy of the OEM's warranty denial if such denial is based on the use of a TRIAX LLC lubricant.
  • Notify TRIAX immediately within 30 days of the failure or alleged defect.
  • Keep the failed parts for inspection by TRIAX LLC, unless given to the OEM.
  • Mail, at your expense, the following items to TRIAX LLC, ATTN: Technical Services, 751 Port America, Suite 810, Grapevine, TX 76051.
  • The six (6) ounce representative oil sample.
  • Documentation describing the make, model, and year of equipment, total accumulated miles and/or hours, and duty cycle or service environment.
  • Equipment or vehicle maintenance history documentation including miles or hours at the time of TRIAX lubricant installation, general equipment repairs, and oil analysis results if available.
  • Proof of purchase for TRIAX product.
  • Batch number from the oil container used in the failed equipment.
  • The OEM warranty denial, if applicable, and claim notice if not previously provided.
  • TRIAX or its representatives reserve the right to inspect failed parts in the event of a claim. Failing to make these parts available for inspection may result in denial of the claim.

If your claim is approved, you will be reimbursed for this mailing expense.

After a Claim is Filed:

  • Cooperate with TRIAX's investigation of the claim and provide the information reasonably requested by us.
  • If your claim is paid by TRIAX or its insurer, an attempt may be made by TRIAX LLC to recover those amounts from the OEM. If this occurs, you may be asked to provide further information pertaining to the failure and must cooperate with TRIAX or its insurer in the recovery process.

Limitation of Liability:

The liability of TRIAX LLC arising out of the manufacture, sale, delivery, installation, technical directions, or recommendation of any lubricant, whether in contract, tort, warranty, or otherwise, shall not exceed the value of the equipment in which the Product(s) were used. In no case shall TRIAX LLC be liable for special, incidental, or consequential damages including, but not limited to, damage or loss of other property or equipment, loss of profits or revenue, cost of capital, business interruption, lodging, towing, or cost of replacement equipment. The remedies to the consumer herein are the sole and exclusive remedies. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. All implied warranties, including but not limited to any warranty of merchantability or fitness for a particular purpose, are strictly limited to the duration of the express warranty applicable to the Products as stated above. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

State Laws Affecting This Warranty:

This warranty shall be governed, interpreted, and construed by, and in accordance with, the laws of the State of Texas, without regard to its conflict of laws principles. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
